Terms of Service

1. Agreement

By creating an account you agree to these terms. If you are using Personify for a company, you confirm you may bind that company. If you do not agree, do not use the service. Our handling of personal data is described in the Privacy Policy, which forms part of these terms.

2. The service

Personify builds a brand persona from information you supply, drafts a month of social posts, and renders those posts — carousels and short-form video — on their scheduled dates. Features are added and changed regularly. We may modify or discontinue parts of the service; if a change materially reduces what a paid plan includes, we will tell you in advance.

Personify is provided as-is, without a service level commitment. It depends on third-party AI and hosting providers, and their outages become ours.

3. Your account

• You must be at least 16 and provide an accurate email address.
• Keep your credentials to yourself; you are responsible for activity under your account.
• One account per person or company unless we agree otherwise.
• Tell us promptly at hello@personify.app if you suspect unauthorised access.

4. Your content and the content we generate

You keep all rights in the material you upload and in your brand. You grant us a non-exclusive licence to store, process, and transmit it to our providers strictly to operate the service for you.

Subject to your plan being paid up, you own the output Personify generates for you and may use it commercially. Two caveats that come from how generative models work: output is not guaranteed to be unique, and similar prompts may produce similar results for other customers. We make no claim that generated output is free of third-party rights, so review anything you publish.

We may use aggregate, de-identified usage statistics to improve the product. We do not use your brand content as marketing material without your written permission.

5. Acceptable use

You agree not to use Personify to produce or distribute:

• Content that is unlawful, defamatory, harassing, or hateful.
• Sexual content involving minors, or sexual content generated from a real person's likeness without consent.
• Deceptive impersonation of a real person or organisation, including political deepfakes.
• Medical, legal, or financial claims you are not qualified or licensed to make.
• Spam, bulk unsolicited messaging, or engagement manipulation.
• Anything that breaches the terms of a connected platform such as Instagram or TikTok.

You also agree not to resell the service, scrape it, reverse engineer it, bypass usage limits, or use it to build a competing model or dataset. Avatars must be based on a likeness you own or have written permission to use. We may suspend an account that we reasonably believe breaches this section, and we will explain why where we lawfully can.

6. AI output — accuracy and review

Copy, images, and video are generated by AI models and can be wrong, dated, or off-brand. Nothing Personify produces is professional advice. You are the publisher: check every post before it goes out, and keep AI-disclosure practices in line with the platform you are posting to. Scheduled rendering means a post can be produced without you looking at it again that day — that is the feature, and reviewing your queue remains your responsibility.

7. Plans, billing, and refunds

Plans and prices are listed on the pricing section. Paid subscriptions will be billed through Stripe in advance, monthly or annually, and renew automatically until cancelled. Cancelling stops the next renewal and leaves your access running until the end of the paid period. Fees exclude any tax we are required to collect.

Generation volumes are capped per plan. Once you hit the cap, generation pauses until the next cycle or until you upgrade. Because each generation costs us real provider spend, used allowances are non-refundable. If something on our side clearly failed, email us and we will make it right — either a re-render or a credit.

We may change prices with at least 30 days' notice; changes take effect at your next renewal.

8. Connected social accounts

Connecting an account authorises Personify to act within the scopes that platform grants, for the purpose of publishing content you have approved. You remain bound by that platform's own terms, and it can revoke access at any time. Disconnect at any point in your dashboard, which deletes the tokens we hold.

9. Ending the arrangement

You can stop using Personify and delete your account whenever you like — see the Privacy Policy for how deletion works. We may suspend or close an account for a breach of these terms, non-payment, or where required by law. Export anything you want to keep before you close your account.

10. Disclaimers and liability

To the fullest extent the law allows, Personify is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or any particular commercial result from content we generate.

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of the service is limited to the greater of the fees you paid us in the three months before the claim, or USD 100. Nothing here limits liability that cannot lawfully be limited.

11. Indemnity

You will indemnify Personify against third-party claims arising from content you publish, material you upload, your use of a likeness, or your breach of these terms.

12. Changes to these terms

We will post revisions here and update the date above. For material changes we will email account holders at least 14 days before they take effect. Continuing to use Personify after that date means you accept the revised terms.

13. Governing law and contact

These terms are governed by the laws of the jurisdiction in which the Personify operator is established, and the courts of that jurisdiction have exclusive jurisdiction over disputes, without limiting any mandatory consumer rights you hold locally. Questions about these terms: hello@personify.app.
